1.General Conditions and Term Dates

1.1 Lessons are invoiced in advance, on behalf of the accredited tutor, for a block of lessons covering one full term.

1.2 Lessons are delivered by tutors accredited by The Rock & Pop Foundation (trading name of Rock and Pop Academy Ltd). These Terms & Conditions are issued by The Rock & Pop Foundation acting as agent for the accredited tutor.

1.3 Tuition is provided across three terms each year, usually aligned with standard school term dates:

Autumn Term: September – December Spring Term: January – March Summer Term: April – July

 

1.4 Where a school follows a different academic calendar, lessons will still be administered under these Terms & Conditions.

 

1.5 The exact start and finish dates of each term will be shown on your invoice.

 

1.6 Enrolment continues automatically from one term to the next (including Summer to Autumn) unless written notice of withdrawal is provided in line with Section 3.

2.Supervision of Students

2.1 Students are under the supervision of their accredited tutor only during their scheduled lesson time. Outside of this period, supervision is the responsibility of the parent/guardian or school.

3.Termination/Cancellation of Tuition

3.1 A student may withdraw from lessons only at the end of a term

3.2 Notice of withdrawal must be given directly to Rock and Pop Academy Ltd as agent for the

accredited tutor, either by telephone or in writing.

To cancel lessons at the end of a term notice must be given before:

3.3.1 - 1st March in Spring Term

3.3.2 -1st July in Summer Term

3.3.3 -1st December in Autumn Term

 

3.4  If notice is not received by the above deadlines, six weeks’ fees will be charged in lieu of notice.

3.5  A Cancellation Reference must be obtained at the time of cancellation. For

this reason, we recommend providing notice by telephone (01252 368330) so that a reference can be issued immediately. Please keep this reference safe — it is proof that proper notice has been given.

3.6 Once lessons have started in any given term, the full term’s fees are payable.

3.7 Parents/guardians/students must not make private arrangements for tuition with accredited tutors within six months of cancellation of lesson

4.Calculation of fees

 

4.1 - Lessons are invoiced in advance on behalf of the accredited tutor, for a block of lessons.

4.2 - Termly fees are calculated according to the number of teaching weeks in each school’s c

calendar, taking into account known school closures at the time of invoicing.

4.3 - Lesson fees cover tuition only, unless otherwise stated on the invoice. (See Section 20 for details of additional charges.)

4.4 - The Rock & Pop Foundation operates a paperless billing system. Invoices are available to view inthe Members’ Area of our website (www.rockandpopfoundation.com

Please contact our head office if you wish to opt out of paperless billing.

5.Payment dates

5.1 For termly fees invoices: Payment is due by the Payment Date shown on the invoice/statement, or

5.1.2 No later than 7 days after the Invoice Date shown on the invoice/statement — whichever is later.

5..2 For students starting part-way through a term, payment is required in advance of the first lesson.

6.Payment methods

6.1 Payments are collected by Rock and Pop Academy Ltd on behalf of the accredited tutor.

All payments are made into a client account and can only be drawn down once lessons are delivered by the accredited tutor.

6.2 Payments can be made:

6.2.1Online – via credit or debit card, using the Members’ Area of our website (www.rockandpopfoundation.com);

6.2.2Telephone – by credit or debit card, by calling 01252 368330;

6.2.3 Cheque – payable to The Rock & Pop Foundation and sent to our Head Office (address shown on the invoice);

6.2.4 Cash – only if paid directly at our Head Office in person. We accept no responsibility for cash payments made by any other method. Do not send cash by post.

6.3 - Payment must not be made directly to the tutor.

6.4 - Payment must not be made through the school.

7.Receipt of payment

7.1 Payment is deemed complete once cleared funds are received in full at our Head Office by one of the approved payment methods listed in Section 6.

7.2 Parents/guardians are responsible for ensuring that payments clear by the due date shown on the invoice. If a payment fails (e.g. a returned cheque or declined card), the invoice will be treated as unpaid until cleared funds are received.

8.Late payment fee

8.1 -  If payment is not received by the due date, a Late Payment Fee will automatically apply after the later of:

either;

8.1.1 -  7 days after the ‘Payment Date’

OR

21 days after the ‘Invoice Date’, whichever shall be the later.

8.1.2  The Late Payment Fee is £30, representing the additional administrative costs incurred by Rock and Pop Academy Ltd in administering overdue accounts.

 

8.3.  The relevant dates referred to in 8.1.1 and 8.1.2 will be clearly shown on your invoice.

9.Failure to pay

9.1.  Failure to pay fees will result in the suspension or cancellation of lessons.

9.2 Rock and Pop Academy Ltd may engage a debt recovery agency to recover unpaid balances on behalf of the accredited tutor.

9.3 Any additional costs incurred in the recovery of unpaid fees will be charged to the parent/ guardian.

10.Instruments and books

10.1 - Instruments, books, and other learning materials must be paid for in full at the time of order, prior to delivery.

10.2 - We offer a 10-week buy-back facility on guitars, drum packs, and keyboards. If lessons are discontinued within this period, items may be returned (at the parent/guardian’s expense) for a refund at the second-hand value determined by Rock and Pop Academy Ltd, subject to inspection and condition.

11.Missed lessons

11.1 Tutors do not provide credits for lessons missed by students.

11.2 Tutors do not provide credits for lessons missed due to school strike action.

11.3 School events: Lessons missed due to school events will not be credited unless the whole school is closed and we are notified at least one month in advance. The tutor may reschedule if a large number of students are absent, but this cannot be guaranteed

 

11.4. Extreme weather: Tutors do not credit for lessons that are missed due to extreme weather (e.g. lessons missed due to school closures and/or transport difficulties caused by snowfall or

 

11.5 Force majeure: No credit is given for lessons missed due to events beyond our control (including but not limited to war, civil disorder, epidemic, or natural disaster). In the event of an epidemic or pandemic, lessons will migrate online (e.g. via Zoom) where possible, with the same day/time maintained.

11.6. If a tutor cannot attend due to illness, transport problems, or similar and no cover can be arranged, a credit will normally be applied. Where possible, the tutor will offer catch-up lessons within the term or arrange an alternative accredited tutor.

11.7 If a make-up lesson is provided, the credit referred to in 11.6 will be removed.

 

11.8 Remaining credits are shown on the next invoice/statement and offset against future fees.

 

11.9 If lessons are discontinued, parents/guardians may request a refund for unused credits. Refunds will be made by the same method as the original payment, and requests must be made within 3 months of the end of the relevant term.

11.10 Lessons continue during GCSE and study leave periods; temporary withdrawal cannot be guaranteed.

 

11.11 For prolonged absence due to illness or other personal circumstances, please contact our Head Office (01252 368330) to discuss possible arrangements.

12.Additional Lessons

12.1 If more lessons are delivered than originally invoiced for a term, the additional lessons will be charged on the following term’s invoice.

 

12.2 If the student does not continue the following term, a separate invoice will be issued for any additional lessons taken.

13.Concerts

13.1 Accredited tutors may organise concerts to showcase students’ progress to parents, schools, or peers.

 

13.2 A concert counts as one scheduled lesson for that term and replaces the normal lesson in the week it is held.

14.Rescheduled Lessons

14.1 From time to time, tutors may need to reschedule lessons temporarily or permanently.

14.2 While we aim to minimise disruption, we reserve the right to adjust lesson schedules if circumstances require. Where possible, reasonable notice will be given

14.3 Lesson schedules are normally published at the start of each term on your invoice/statement.

14.4 If changes are made, Rock and Pop Academy Ltd may notify you by:

 

Letter to the main contact address on record, or telephone call to the main contact number on record,or Email to the email address on record, or Direct notification from the tutor to the student.

 

14.5  Where, in the reasonable opinion of Rock and Pop Academy Ltd, it is educationally or operationally beneficial to do so, a small group lesson involving two students may be replaced with individual one-to-one lessons of 15 minutes' duration per student. Any such arrangement will be considered equivalent to the original lesson format and will satisfy the student's weekly tuition entitlement.

 

15.Refusal of Tuition

15.1 Accredited tutors reserve the right to refuse tuition to any student, either temporarily or permanently, at their reasonable discretion.

 

15.2 Grounds for refusal may include (but are not limited to):

15.2.1 Late or non-payment of fees;

15.2.2 Behaviour that disrupts lessons or negatively affects other students;

15.2.3 Abusive, aggressive, or threatening language or conduct towards staff, tutors, or other students;

15.2.4 Failure to comply with health & safety requirements or safeguarding rules.

 

15..3 If tuition is refused under this clause, no credit or refund of fees will be given.

16.Website Access

16.1 Access to the Members’ Area of the Rock and Pop Foundation website is available to students and parents/guardians only while the student is enrolled in lessons with an accredited tutor.

16.2 Access may be withdrawn at any time at the reasonable discretion of Rock and Pop Academy Ltd, including (but not limited to) cases of misuse such as unauthorised sharing of login details.

17.Queries and Disputes

17.1 Any outstanding balance must be paid in full and on time, even if there is a query or dispute relating to lessons or invoices.

17.2 Rock and Pop Academy Ltd will make every reasonable effort to resolve queries or disputes promptly.

17.3 Parents/guardians should notify us of any query or dispute by telephone (01252 368330) within 24 hours of it arising, and confirm in writing within 7 days.

17.4 Unless lessons have been cancelled in line with Section 3, all fees shown on the invoice remain payable.

17.5 All queries or disputes must be raised before the end of the relevant term; issues raised after this time cannot be considered.

18.Acceptance of these terms and conditions

18.1 By enrolling in lessons, you agree to these Terms and Conditions. Acceptance may be demonstrated by any of the following:

 

18.1.1 Completing a Rock and Pop Foundation enrolment form;

18.1.2 Completing the initial enrolment process;

18.1.3 Making payment of an invoice; or

18.1.4 The student attending a lesson.

 

18..2 By accepting these Terms and Conditions, parents/guardians also agree to be bound by any future revisions as published by Rock and Pop Academy Ltd.

19.Changes to lesson prices and to these terms and conditions

19.1 Rock and Pop Academy Ltd reserves the right to change the prices of lessons and other items. Any such changes will be published in advance and will take effect from the start of the next school term.

19.2 Rock and Pop Academy Ltd also reserves the right to amend these Terms and Conditions. Any revisions will be published online and/or communicated in writing before they take effect and will apply from the start of the next school term.

19.3 If you do not accept revised prices or terms, you may withdraw from lessons in line with Section 3.

20.Administration and other charges:

20.1 All lesson fee invoices carry a standard administration charge of £5.95 per term.

20.2 Books, instruments, and other materials do not incur administration charges but may carry delivery charges, which will be confirmed at the time of order.

21.Privacy

21.1 Rock and Pop Academy Ltd is committed to protecting your personal data in accordance with the Data Protection Act and the UK General Data Protection Regulation (GDPR).

21.2 Our Privacy Policy explains what personal data we collect, how we use it, and your rights under data protection law. The full policy is available on our website: www.rockandpopfoundation.com

21.3 For the purpose of delivering lessons, relevant personal data may be shared securely with accredited tutors.

21.4 By enrolling in lessons, you acknowledge and accept the terms of our Privacy Policy.
